Second, a written or windshield notice giving the owner a chance to move the vehicle, with a waiting period that varies by state (24 hours is common, some states require 48-72 hours, and inoperable or unregistered vehicles often get a 7-30 day cure window). Miss either requirement and the tow is generally improper, exposing both the HOA and the tow operator to liability for the owner's return costs.

When an HOA can tow immediately

Safety and access violations are the near-universal exceptions.
