Terms of Service

Effective May 4, 2026. These Terms govern your use of SmartLotIQ. They include a binding arbitration agreement and a class-action waiver (Section 18). You may opt out of arbitration within 30 days of first accepting these Terms by writing to legal@smartlotiq.com.

Highlights

• 3-day free trial. Auto-renewing monthly or annual subscription. Cancel anytime from the dashboard; no refunds for unused portions of a paid term.
• Customer owns its Customer Data; SmartLotIQ acts as processor / service provider for resident, guest, and vehicle data — see the DPA.
• Acceptable Use: no unlawful, infringing, surveilling, or high-risk safety-critical use. No HIPAA-protected health information. No use to violate the TCPA, FCRA, DPPA, or state ALPR laws.
• Service is provided "as is". To the maximum extent permitted by law, total aggregate liability is capped at the greater of fees paid in the prior 12 months or US$100.
• Disputes resolved by binding individual arbitration administered by the AAA in Hillsborough County, Florida. Governing law: Florida. Claims must be filed within one year.
• Customer indemnifies SmartLotIQ for claims arising from Customer Data, enforcement actions, and use of the Service in breach of the Terms.

SMS / text messaging terms

By providing a phone number to SmartLotIQ or any Property using SmartLotIQ, you agree to receive transactional SMS text messages from SmartLotIQ related to your parking pass, guest arrivals, violations, and gatehouse contact. Message and data rates may apply. Message frequency varies and is typically only when a parking pass is issued, a guest arrives, or a violation is recorded. Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any SmartLotIQ message to opt out at any time. Reply HELP or INFO for help, or contact support@smartlotiq.com. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We do not sell, rent, lease, or share mobile phone numbers, SMS opt-in records, consent timestamps, or message content with third parties for marketing or any other purpose.
